Abstract: The optimum definition of the term "genocide" has been hotly contested almost since the term was coined. Definitional boundaries determine which acts are covered and excluded and thus to a great extent which cases will benefit from international attention, intervention, prosecution, and reparation. The extensive legal, political, and scholarly discussions prior to this article have typically (1) assumed "genocide" to be a fixed social object and attempted to define it as precisely as possible or (2) assumed the need for (...) a fixed convention and sought to stipulate the range of events that should be denoted by the term. Even if its meaning is a matter of convention, however, "genocide" is not a fixed object but varies by context and evolves in methods and forms over time. In fact, as relevant laws, legal interpretations, and political commitments develop, so do would-be perpetrators modify what genocide is in order to avoid political and legal consequences. This article advances an approach to a definition of "genocide" that allows even legal definitions to keep pace with this evolutionary process. (shrink)

The measurement of food intake has long been used to describe ‘adaptation’ to low energy intakes in certain tropical peoples. However, the methods available to quantify food intake are unlikely to reflect accurately real energy intakes in free living peoples. Alternatively, estimating energy expenditure shows some promise—particularly the measurement of basal metabolic rate . The BMR may be measured effectively in males, but females show wide intra-individual variation in BMR during their menstrual cycle, which makes BMR measurements more difficult to (...) interpret in the context of adaptation. The use of double-labelled water may be the only method suitable to quantify and define ‘adaptation’ to low intakes in women. (shrink)

Beginning from the standpoint that technologically mediated education is widely prescribed for developing countries, the author first probes the nature, meaning, and impact of this agenda through its economic and political context. He argues that this context produces and shapes the rush to technology. He then examines the notion of education and the nature of the claimed technological mediation of this process, concluding that the constraints of technological mediation, and its destructive impact on teaching, show its inability to provide for (...) adequate educational development (which is necessarily grounded in a concrete human relationship in a real—not virtual—dynamic social and cultural context). He closes with recommendations for a critical rather than a wholesale adoption of technology and encourages resistance to the present press for mindless adoption. (shrink)

Peirce manuscript 1570 "The First of Six Lessons . . ." and its context, provides uniquely valuable access to Peirce's religious practice (as distinct from his theology). Chronically unemployed, Peirce seized an opportunity to put in a bid for a vacant post in elocution at the Episcopal Church's major (and only "official") theological seminary, The General Theological Seminary in New York City. Peirce had on occasion appealed to nearby members of (...) the Episcopalian hierarchy seeking patronage for his scholarly work—to no avail. In this case, however, he was encouraged and aided by the current scholarly vicar of his own parish. The incumbent had pursued advanced education abroad and was also active in the seminary's affairs. And, of course, Peirce was confident about his expertise in elocution, which "General's" Dean claimed as well. Both the contextual narrative and the substantive theological content of his "lesson" are a rich resource for insights into the much vexed (if too often muddled) question of his lifelong commitment to a faith stemming from his earlier conversion to trinitarianism. What explains the continuing hardship of so many black Americans? A distinguished group of scholars analyzes the long, complex structural and environmental causes of discrimination and their effects on African-Americans. The authors examine the impact of poverty, poor health, poor schools, poor housing, poor neighborhoods, and few job opportunities—and demonstrate how multiple causes reinforce each other and condemn African-Americans to positions of inferiority and poverty. Some of the contributors examine policies designed to correct problems, while others look at the changing (...) racial and ethnic composition in America and its implications for African-Americans, as other minorities surpass them in numbers and claim political, economic, and social attention. Psychologists have traditionally approached phenomenology by describing perceptual states, typically in the context of vision. The control of actions has often been described as 'automatic', and therefore lacking any specific phenomenology worth studying. This article will begin by reviewing some historical attempts to investigate the phenomenology of action. This review leads to the conclusion that, while movement of the body itself need not produce a vivid conscious experience, the neural process of voluntary action as a whole has distinctive phenomenological consequences. (...) The remainder of the article tries to characterise this phenomenology. First, the planning of actions is often conscious, and can produce a characteristic executive mode of awareness. Second, our awareness of action often arises from the process of matching what we intended to do with what actually happened. Failures of this matching process lead to particularly vivid conscious experience, which we call 'error awareness'. These features of action phenomenology can be directly related to established models of motor control. This allows an important connection between phenomenology and neuroscience of action. Third, whereas perceptual phenomenology is normally seen as caused or driven by the sensory stimulus, a much more fluid model is required for phenomenology of action. Several experimental results suggest that phenomenology of action is partly a post hoc reconstruction, while others suggest that our awareness of action represents an integration of several processes at multiple levels of motor processing. Fourth, and finally, studies of the phenomenology of action, unlike those of perception, show a strong linkage between primary awareness and secondary awareness or self-consciousness: awareness of action is specifically and inextricably awareness of my action. We argue that the concepts of agency and of proprioaction are fundamental to this linkage. For these reasons, action represents a much more promising field than perception for attacking the problematic question of the relation between primary and secondary consciousness. This study provides an evaluation of ethical business perception of busIness students from three countries: Australia, Taiwan and the United States. Although statistically significant differences do exist there is significant agreement with the way students perceive ethical/unethical practices in business. The findings of this paper indicate a universality of business ethical perceptions.

Benjamin Constant (1767–1830) is the most important French liberal that most casual liberals have never heard of. Everyone knows something about Montesquieu because checks and balances and the separation of powers are household terms. Tocqueville’s Democracy in America and The Old Regime and the Revolution are both established classics. But Constant is largely terra incognita even for those with a university degree—to their loss.

Recent philosophical discussions have failed to clarify the roles of the concept fitness in evolutionary theory. Neither the propensity interpretation of fitness nor the construal of fitness as a primitive theoretical term succeed in explicating the empirical content and explanatory power of the theory of natural selection. By appealing to the structure of simple mathematical models of natural selection, we separate out different contrasts which have tended to confuse discussions of fitness: the distinction between what fitness is defined as versus (...) what fitness is a function of, the contrast between adaptedness as an overall property of organisms and specific adaptive capacities, the distinction between actual and potential reproductive success, the role of chance versus systematic causal relations, fitness as applied to organisms as opposed to fitness applied to genotype classes, heritable adaptive capacities of genotypes as opposed to relations between genotypes and the environment. We show how failure to distinguish and properly interrelate these different aspects of “fitness” adds confusion to a number of already complex issues concerning evolutionary theory. On the basis of our discussion of these different aspects of “fitness”, we propose a terminology which makes the necessary distinctions. A central result of our analysis is that the concept of fitness as the overall adaptedness of organisms does not enter into the causal structure of evolutionary explanation, at least to the extent that this structure is represented in the mathematical models of natural selection. 1. Introduction. Professor Nagel's account of the “cognitive status” of scientific theories has been attacked by P. K. Feyerabend [5] and M. B. Hesse [8] in terms of his alledgedly misguided distinction between experimental laws and theories. The difficulty lies, these critics agree, in Nagel's attempt to find a stable basis for scientific theories in an observational basis of experimental laws. Both Feyerabend and Hesse note the vacillation in Nagel's account of the stability of the meaning of experimental terms and (...) in his discussion of the status of observational as opposed to theoretical terms. They find Nagel too “positivistic” and see as a first step toward a more adequate account of scientific theories the abandonment of the theoretical-observational dichotomy as having more than a pragmatic significance. Nagel's discussion of the theoretical-observational dichotomy is, I agree, inadequate in certain respects. I shall, however, suggest a quite different remedy from those of Feyerabend and Hesse, one that depends neither on a phenomenalistic reduction of theoretical entities nor on a blurring of the theoretical-observational dichotomy.
